1. ACCEPTANCE
This Agreement (the "Agreement") contains important terms and conditions which govern the following services: ("Internet Financial Services"), You understand and agree that by using the Services, you are accepting the terms and conditions of this Agreement, and that your use of your Customer ID and Password will be considered the same as your written signature in authorizing us to complete any transaction or request communicated to us. All electronic communications that meet these requirements will be deemed to be valid and authentic and you intend and agree that those electronic communications will be given the same legal effect as written and signed paper communications. You agree that electronic copies of communications are valid and you will not contest the validity of the originals or copies, absent proof of altered data or tampering. Because the Services are performed electronically, they are governed by all domestic, national and international laws and regulations pertaining to electronic funds transfers which entitle you to certain benefits and protections, which are contained in this Services Agreement.
2. REQUIREMENTS
a) Account Access.
To access your account via the Services, you must have at least one eligible deposit or loan account, a Customer Identifier ("User ID"), and a password (the "Password") that you choose. You may only designate accounts that you own jointly, severally or otherwise or that you have the authority to use. You agree to provide us with any additional documentation we may require to permit access to your account. If you apply for an account or service via Internet, or ask to change an account or service you already use with us, you agree that we can treat your application or request as if it had been made in writing and signed by you. You understand by enrolling for services, that you authorize us to investigate and verify any information supplied by you. You authorize us to make any credit or investigative inquiry for use our services
(b) Multiple Signatures.
Accounts that require two or more persons acting jointly through signature or otherwise, for withdrawals, fund transfers, bill payment or other transactions, are ineligible for the Services.
(c) Joint Accounts.
If you have designated a joint account to be accessible via the Services, each joint owner will be jointly and severally liable under this Agreement. We may act upon the instructions of any joint owner concerning the account without the consent of any other person. Any person(s) to whom you give your User ID and Password will also be considered by us to be authorized users.
(d) Special Withdrawal Limitations.
Exchange regulations limit your ability to transfer funds between certain accounts, as described in the terms and conditions governing your deposit account (the "Deposit Agreement"). For example, you can make no more than 6 transfers from a savings or money market savings account during each monthly cycle, and in the case of a money market savings account, no more than 3 of such transfers may be made by check. Transfers to another account or for making payment to a third party by means of a preauthorized or telephone agreement, order or instrument, withdrawals using a telephone, items processed through the Services, and checks are all counted against the permissible number of transfers, as are other transfer methods described in your Agreement, except where the transfers are made to pay on a loan with us.
(e) Limitations and Dollar Amounts for Transfers and Payments.
Transfers from one designated account to another may not exceed the available balance in your account from which the transfers are made. Payments are limited to a standard $10,000 per bill and may not exceed the available balance in the account from which payments are made. We reserve the right to limit the frequency and dollar amount of transactions from your designated accounts for security reasons. Any limits that vary from the standard bill pay amount will be disclosed at the time of enrolment.
(f) Your Password.
We will be entitled to act on all instructions received under your Password. Since your Password is used to identify you as an authorized user of the Services, you agree to notify us immediately if the secrecy of your Password is compromised, and you also agree not to reveal your Password to any person not authorized to use the Services. The security of your Account depends upon maintaining the secrecy of your Password. You may change your Password at any time while you are using the Services.
You must use your Password to access your account(s), pay bills, or perform online transactions. To assist us in maintaining the security of your Services account(s), we may revoke or cancel your Password at any time without giving you prior notice.
You agree not to use your Password for any transaction that would cause your account balance to go below zero. We will not be required to complete any such transaction, but if we do, you agree to pay us the amount of the improper withdrawal or transfer upon demand and any associated fees for such service. Otherwise, you authorize us to collect any such amounts, including the amount of the service fees you may owe us from any account you maintain with us.
(g) Protecting Your Account.
You are solely responsible for maintaining Password secrecy. Your Password is used to gain access to the Services. For your protection, we recommend you memorize your Password and do not write it down. For added security, you should change your Password periodically. A properly constructed password affords you a greater degree of assurance.
A password is more secure if:
a)it contains more characters.
b)if those characters are both alpha and numeric characters.
c)if it consists of both upper and lower case.
d)if it contains symbols, i.e.$,%<*,# etc...
You should also take precautions to protect your personal identification information, such as your driver's license, Social Security Number, etc. Someone may use this information alone, or in conjunction with other information, to access your account. If you believe that your Password has been lost or stolen, or that someone has transferred or may transfer money from your account without your permission, notify us immediately by faxing the number above. We reserve the right to deny access if user verification cannot be determined.
(h)Your Computer.
You agree to be fully responsible for the installation, maintenance and operation of your computer and software. We are not responsible for any errors or failures from the malfunction of your computer, software, or for any computer virus or related problems associated with the use of an on-line system. If you are accessing the Services through the Internet, you will be responsible for contracting with your own Internet Service Provider ("ISP"). You must also meet the minimum browser requirements set forth on our web site.
(i) Secure Electronic Messaging Services.
You may communicate with us through our secure messaging service. This messaging service will be available to you when you sign on to the Services with your User ID and Password. To ensure the security of your account information, we encourage you to use only this service when transferring information to us regarding your account.
(j) New Services.
We may, from time to time introduce new Internet services. You will be notified of these services and we will update this Services Agreement to incorporate any new services. If you are a consumer, your use of the new services will signify your acceptance of the terms and conditions governing these new services. If you are a business, we will not make any new services available to you unless we have received proper authorization from you.
(k)Fees and Charges.
The fees and charges for the Services available through are set forth later in this Agreement. You agree that we may change the terms of this Agreement, including the fees, at any time, and you will be notified of any such change by mail or by an electronic message. You understand and agree that by using the Services after any change becomes effective, you have agreed to it you will have agreed to the changes.
(l) When You May Access Your Account.
Subject to conditions beyond our control, you can access your accounts via the Services, 7 days a week, 24 hours a day. There may be times, however, when some or all of the Services may not be available due to system maintenance. .
3. INTERNET EXCHANGE SERVICES
(a) What You Can Do.
If you have enrolled in the services, you may:
- Obtain balance information, account detail information and transaction history on all eligible accounts enrolled in Internet. Unless otherwise noted, account balance information reflects the prior business day's account balance. Transactional history reflects activity through the close of business of the previous business day. For Internet, our business days are Monday through Friday, excluding federal holidays.
- Request a withdrawal from your account.
- Transmit secure electronic messages to the service provider and merchant.
(b) Balance Inquiries.
You may use the service to check the balances and recent which the balance is current. The balance shown may not be your actual available balance. It may include deposits still subject to verification by us. The balance shown may also differ from your records because it may not include deposits in progress, outstanding checks, or other withdrawals, payments, or charges, or items in process.
(d) Stop Payments.
You may initiate stop payment requests online only for paper checks you have written (non-electronically) on your account. On-line stop payments made after 10 PM will be deemed received the next business day. By placing a stop payment order on-line, you have authorized, directed and requested us to stop payment on the check requested. You agree to indemnify and hold us harmless from any and all claims, liabilities, costs and expenses, including but not limited to, court costs and reasonable attorney fees, resulting from or growing out of the our refusal to pay the stopped check. We shall have no liability to you for the payment of the identified check contrary to this stop payment order if the indicated check number, dollar amount or account number is not accurate. We are not liable to you if we paid the identified check if we acted in good faith or exercised ordinary care. Any damages that you incur and which we may be liable for are limited to actual damages not to exceed the amount of the check. You understand that if the stop payment order comes too late for us to have a reasonable time to act on it prior to accepting, certifying, paying, settling for, posting or becoming accountable for the check, that this stop payment order shall be of no effect. You agree that we may charge you a fee for processing this stop payment order as well as a similar fee for each renewal you make, such fee to be deducted from your account. Refer to the current schedule of fees for your account. This stop payment order shall be valid for a period of six (6) months from the date it is made unless we have received a revocation or renewal prior to expiration of such period.

II. Terms of Use
By using this website and service you represent and warrant that you (“the enrolled user”) have read, acknowledge and agree to be bound by the terms and conditions of as detailed herein. You further represent and agree that: (i) you have the power and authority to enter into this agreement; (ii) you are at least eighteen (18) years old; (iii) you will comply with all domestic and international law regarding the transmission of any data obtained from the Service in accordance with the terms and conditions of service, (iv) you will not use the Service for illegal purposes, and (v) you will not interfere or disrupt networks connected to the Service. IF YOU DO NOT ACCEPT THESE TERMS OF USE, DO NOT USE THIS WEBSITE AND SERVICE.
- Changes. Please check these terms of use frequently, as we may occasionally unilaterally change the terms of use by revising the language contained on this page. The most current terms of use will always be available for you on this page. Amendments to the terms of use are effective at the time they are posted on this page, and your continued use of this website will constitute your acceptance of such amendments.
- Service Description. The service offers tools and facilities for the purchase of gold or foreign currency by an enrolled user, and the subsequent sale of gold or foreign currency to member merchants for the purpose of paying for goods or services that an enrolled user has purchased from member merchants. The gold and foreign currency is held on the enrolled user’s behalf in accounts maintained by the SERVICE PROVIDERS on behalf of the enrolled user. The effective rate for the purchase and sale of gold of foreign currency is set by the SERVICE PROVIDERS Providers and are subject to change from time to time based on all market factors. Transactions are subject to a transaction service fee that is set by the SERVICE PROVIDERS. All rates are confirmed at the time of each transaction and any transaction subject to the enrolled users confirmation and agreement.
- Right to Use. We reserve the right to modify or discontinue any component of this website or any of these terms of use. We expressly reserve the right to terminate your right to use this website.
- User Accounts. You are responsible to safeguard your account information and agree to hold the provider of services harmless from any claims resulting from the improper use of your account information.
- Copyright. All content included on this site, including software, graphics, and logos is the property of VENDOR and/or our customers for whom we provide payment services (collectively “Service Providers”) and is protected by applicable copyright laws.
- Trademarks. Any marks indicated on this site are registered trademarks of SERVICE PROVIDERS, or their subsidiaries, internationally. These trademarks may not be used in connection with any product or service that are not SERVICE PROVIDERS's, in any manner that is likely to cause confusion among customers, or in any manner that discredits or disparages SERVICE PROVIDERS.
- License. SERVICE PROVIDERS grant to you a limited license to access this website and not to download or modify any portion of it, except with the prior express written consent of SERVICE PROVIDERS. This license does not induce any resale or commercial use of this website or its contents. No portion of this website may be reproduced, resold, linked or otherwise exploited for any commercial purpose without the express written consent of SERVICE PROVIDERS. Any unauthorized use terminates this license.
- Indemnification. You agree, at your own expense, to indemnify, defend and hold harmless SERVICE PROVIDERS and related parties, against any claim, suit, action or other proceeding brought against SERVICE PROVIDERS and related parties, by a third party, to the extent that such claim, suit, action or other proceeding brought against SERVICE PROVIDERS and related parties is based on or arises in connection with the Service, or any links on the Service, including, but not limited to: (i) your use or someone using your computer for use of the Service; (ii) your use or someone using your account, where applicable; (iii) a violation of the terms and conditions of service by you or anyone using your computer (or account, where applicable); (iv) a claim that any use of the Service by you or someone using your computer (or account, where applicable) infringes any intellectual property right of any third party, or any right of personality or publicity, is libelous or defamatory, or otherwise results in injury or damage to any third party; (v) any deletions, additions, insertions or alterations to, or any unauthorized use of, the Service by you or someone using your computer (or account, where applicable); (vi) any misrepresentation, including false or inaccurate Information, or breach of representation or warranty made by you contained herein; or (vii) any breach of any covenant or agreement to be performed by you under these terms and conditions of service. You agree to pay any and all costs, damages and expenses, including, but not limited to, reasonable attorneys' fees and costs awarded against or otherwise incurred by or in connection with or arising from any such claim, suit, action or proceeding attributable to any such claim.

SERVICE PROVIDERS do not warrant that the website or any content or service provided in connection with the website will be timely, error-free, uninterrupted, secure, or that defects will be corrected. SERVICE PROVIDERS will not be responsible for any errors, omissions, interruptions, defects, deletions or delays in the operation or transmission of the website or any services or content, or for computer viruses associated with the operation of the website. SERVICE PROVIDERS make no warranty regarding any information made available through the website. SERVICE PROVIDERS MAKE NO EXPRESS OR IMPLIED WARRANTIES WITH RESPECT TO THIS WEBSITE, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. - Limitation of Liability. Neither SERVICE PROVIDERS, nor their subsidiaries, affiliates, officers, directors, employees, suppliers, successors or assigns will be liable to you or to any third party for any indirect, consequential, incidental, exemplary, special or punitive damages (including without limitation damages resulting from lost profits, lost revenue, last data, or substitute costs) arising out of or in connection with this website or the services available on or through this website, regardless of whether such parties have been made aware of the possibility of such damages. CERTAIN STATE LAWS DO NOT ALLOW FOR THE LIMITATION OF IMPLIED WARRANTIES OR FOR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. - Miscellaneous. SERVICE PROVIDERS operate this website out of headquarters in USA. If you use this website from other locations you are responsible for compliance with all applicable local laws and regulations. If any provision of the terms and conditions of service, or the application thereof, is found invalid or unenforceable, that provision will be amended to achieve as nearly as possible the same economic effect as the original provision and the remainder of this agreement will remain in full force. These terms of use will be governed by the substantive laws of the united states ( USA), regardless of where you reside or transact business with SERVICE PROVIDERS. Use of this website will be deemed to take place solely in USA. You agree that the district court located in USA will have the exclusive jurisdiction over any and all disputes arising out of or relating to these terms of use of our use of this website and that you will submit to the jurisdiction of such court. The prevailing party in any dispute will be entitled to reasonable attorney's fees and costs.
